Terms and Conditions

The following terms and conditions are a part of the confirmation of work to be performed by Harmony Tree Service, and with the information on the front/ electronic copy constitute entire Agreement.


Work crews may arrive at the job site unannounced unless otherwise noted or pre-arranged. Harmony Tree Service shall attempt to meet all scheduled dates, but shall not be liable for damages due to delays for inclement weather or others caused beyond its control. The customer shall not be relieved of his responsibility because of delays.


All work will be performed in a professional manner by experienced personnel outfitted with the appropriate clothing, tools and equipment to complete the job properly. Unless otherwise indicated herein, Harmony Tree Service will remove wood, brush, and debris incidental to the work.


Work performed is done in accordance to ANSI 300 Pruning standards for Tree Care Operations. If our crew comes across a situation where the climber should make a decision on removing/ preserving a branch at anytime during work, that is not specified on the contract, decision will be made according to the standard.


Harmony Tree Service holds $2,000,000 General Liability insurance for damage resulting from injury to persons or property, and has Workers / Compensation Insurance (WSIB) coverage for its employees. Documents will be presented upon request.


The customer warrants that all trees, and property, upon which work is to be performed, are either owned by him or that permission for the work has been obtained from the owner. Harmony Tree Service is to be held harmless from all claims for damages resulting from the customer’s failure to obtain such permission.


Please note that all service provided is taxable. We accept Cash, Credit Card (except AMEX), Cheques (Payable to Harmony Tree Service) and e-Transfer as a payment method. All accounts are net payable upon completion of work. A service charge of 3% per month will be added to accounts thirty days after invoice date, If outside assistance is used to collect the amount, the customer shall be responsible for all costs associated with the collection including, but not limited to, attorney’s fees and court costs. There will be a charge of $65 for returned cheque from financial institutions.


Customer shall indicate to Harmony Tree Service the corners of the property and shall assume all responsibility for accuracy of markers. Customer shall provide a copy to Harmony Tree Service of any restrictions, easements, or right of ways prior to commencement. When access to neighbour’s property is required to perform work, permission should be obtained by the customer prior to the crew’s arrival.


Customer represents that he has no knowledge of any concealed utility lines, gas pipes, irrigation hose, other than those, if any, please set forth on the face page of this Agreement as a special remark.The Customer shall be liable for damage to underground facilities or obstructions unless the Customer gives to Harmony Tree Service in writing the exact location of said facilities and obstructions in advance of any work being done.


Customer shall provide free access to work areas for Harmony Tree Service’s employees and vehicles and agrees to keep driveways clear and available for movement and parking of required trucks and equipment during normal work hours. Harmony Tree Service’s employees shall not be expected to keep gates closed for animals or children.


Customer agrees to compensate Harmony Tree Service on time and materials basis for any additional work required to complete the job occasioned by concrete, metals or other foreign matter within tree trunk, or bee-hives in the tree, rock, pipe, or electrical lines encountered in excavations and not describe on the agreement, or any other condition not apparent in estimating the work specified.


Tree will be cut down to grade within reasonable work zone of a chainsaw. We do not cut a stump vertically or below grade with a chainsaw. Customer understands that a chainsaw cannot cut through any material other than wood. For example, if a stump is covered with soil, it will be cut above the soil’s reach (refer to Stump Removal). Some lawn damage is unavoidable during Tree Removal. Sawdust, leaves, and wood chips are incidental to the removal of any material, and as such shall not be considered as damage.


Stump removal is not included in a Tree Removal Agreement unless specifically provided for on the face page hereof. Stumps will be ground approximately Eight (8) inches below ground level unless specified to the contrary on the face page of this Agreement. Stump debris will be used to fill back the hole. It can be hauled away at an extra charge depending on the size of the stump. Generally, a stump grinder requires minimum 3’ clearance and fairly even ground without excessive slope or obstacles. Customer understands that the job cannot be performed without access for the machine and Harmony Tree Service should not be liable.


An Arborist Report contains professional and honest opinion of an Arborist from a site visit. Tree inspection will be performed visually, on the ground without climbing. Aerial inspection can be performed at an extra cost. A report should not be considered a guarantee of tree’s stability or longevity. Harmony Tree Service should be held harmless from any unexpected damages caused by internal/ underground flaw of the subject tree that cannot be noticed visually. The fee is non-refundable and amendments will be charged accordingly.


Any object or plants within the understory of trees that is/are identified as a “target” is the client’s responsibility to either move or waive rights to claim damages to such unless provided for in writing on front of contract, as above damages. Although our crew remove them from work zone prior to start, we should not be expected to be aware of everything.


When a customer wishes to withdraw from a signed contract, he/she shall notify Harmony Tree Service at least 48 hours ahead of the scheduled date or they will be charged 5% of contract. If the crew arrives at the customer’s property prior to cancellation, customer agrees to pay a minimum service call charge equal to 20% of contract. In cases where special equipment has been acquired for the purpose of completion of said project; such as rental equipment, non-returnable equipment, or any other items specific for the safety of crew members, the cost for these items shall be paid by the customer.
